1) Eligibility: The Easy To Use-Easy To Win Game and Sweepstakes! (the "Sweepstakes or Promotion") is open only to legal residents of the United States (excluding Puerto Rico, U.S. Virgin Islands and Guam) who are 18 years of age or older (must be 19 years of age or older in the state of ME) at the time of entry. Residents of Alaska or Hawaii are not eligible to win the Instant-Win Game. Employees of Avery Dennison Office Products Company (the “Sponsor”), Avery Dennison Corporation or any of its subsidiaries or affiliates, COHEN-FRIEDBERG ASSOCIATES, LLC (the “Administrators”) and Staples, Inc. (collectively, the “Promotion Entities”), and all of their respective parents, subsidiaries, dealers, franchisees, affiliates, directors, officers, shareholders, governors, employees, and agents, as well as their respective spouses, children, siblings, and all others residing in the same household as such employees, are not eligible to participate. The Promotion is subject to all federal, state, and local laws and regulations. Void where prohibited by law.
2) Agreement to Official Rules: By participating in this Sweepstakes, each entrant agrees to abide by these Official Rules and the decisions of the Administrators, which are final and legally binding as they pertain to this Sweepstakes. All entries become the property of the Sponsor.
3) Timing: Promotion starts at 12:01 am Eastern Time (“ET”) on Tuesday, December 1, 2009 and ends 11:59 pm ET on Sunday, March 28, 2010 (the "Promotion Period"). The clock maintained by the Administrators in connection with the operation of the Promotion at the promotion website (the “Website”) will be the official timekeeper for this Promotion. LIMIT: One (1) Sweepstakes registration per email address over the course of the promotion, one (1) instant win game play per day and one (1) prize per person or household.
4) THERE ARE 2 WAYS TO WIN:
a) Easy To Use-Easy To Win Sweepstakes.
(i) How to Enter to Win The Grand Prize: You may enter the Grand Prize Sweepstakes by visiting www.avery.com/easytowin, click on the “Easy To Use-Easy To Win Game and Sweepstakes!” icon or banner to complete the online Registration form and click “submit”. Registration may include the following: name, complete address, city, state, zip, age, email address and telephone number. After you have submitted your registration, you will automatically be entered into the Grand Prize Sweepstakes where you could win a trip to Aruba (details herein).
(ii) Drawings & Winner Selection: A random Sweepstakes drawing will be conducted on or about Thursday, April 15, 2010 from all valid entries received. The Sweepstakes drawing will be under the control of the Administrators whose decisions shall be final and legally binding as they pertain to this Sweepstakes. Winner will be notified within 10 days of the drawing via phone, email, mail or express mail whichever is appropriate. Failure to reply to this prize winning notification within 10 days of notification to claim prize, will disqualify the entry and an alternative winner will be selected from all eligible entries received for the Sweepstakes. Odds of winning depend on the total number of eligible entries received. Incomplete, illegible or mutilated entries will be automatically disqualified. No responsibility is assumed for lost, late, misdirected, damaged, altered or illegible entries. Any attempted form of entry other than as described herein is void. Administrators and or Sponsor will determine in it sole discretion what constitutes a valid entry.
(iii) Sweepstakes Grand Prize Winner Notification: The Grand Prize winner will be required to complete and return an Affidavit of Eligibility and a Liability/Publicity Release form which must be signed by the Winner and guest and received by Sponsor or its designated agent within ten (10) days of the date printed on the notification or otherwise an alternate Winner will be selected from all remaining valid entries. If the Winner is under the age of majority, a parent or legal guardian will be required to execute the Affidavit of Eligibility and a Liability/Publicity Release form on the Winner's behalf. Prizes won by a minor will be awarded in the name of a parent of legal guardian, for the benefit of the minor. If the winner of the Grand Prize is a minor, his/her parent or legal guardian must travel as one of the guests.
(iv) Potential Sweepstakes Winners: ALL Potential winners must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Each potential winner of a major prize (prize valued over $600) must complete, sign and return an Affidavit of Eligibility and Liability/Publicity Release within ten (10) days, consenting to the publication of his/her name in any media for any promotional purpose relating to the announcement of winners of the Promotion, without further compensation. If a potential winner cannot be contacted or if he/she fails to sign and return the Affidavit of Eligibility and Liability/Publicity Release within the required time period or if notices are returned as undeliverable, an alternate winner will be selected from all valid entries remaining in the drawing pool. Eligible winners will receive their prize within 4-6 weeks after the return of the required winners’ documents.
b) Easy To Use-Easy To Win Game (“the Game”)
(i) How to Enter to Win A Staples Gift Card: After Registering for the Grand Prize Sweepstakes during the Promotion Period, you will automatically advance to a web page where you have the option to play an Instant-Win Game where you have the chance to win a Staples Gift Card. You can return to play the Game without Re-registering by visiting www.avery.com/easytowin, logging in utilizing your “e-mail address” and your game “password” obtained when you registered for the Grand Prize Sweepstakes. You may play the Game daily.
(ii) How to play the Game: Each time you enter the game page, you will be offered the opportunity to play the Easy To Use-Easy To Win Game. The game objective is to place one (1) Avery label in each of the four (4) rooms shown on the game board. Utilizing your computer mouse curser, click on one (1) of the rooms, next, “click and drag” one of the Avery labels to the game space. The player must determine which Avery label that would work best in each room’s environment. Place all four (4) labels in position and the player will instantly know if he or she had a game winning play and the prize won (pending verification). Check the instant prizes available to be won (See Rule #5). A winning game play message will advise winner when to anticipate the delivery of his/her prize. Limit: One (1) Game Play per person or email address per calendar day (as determined by the Website’s clock Eastern Time) during the Promotion Period. Only one prize per email address or household over the Promotion Period.
(iii) Validation Code. All winning game plays will contain a one time use security code validation code. No prize will be awarded on any game play or screen shot not containing such code. Only the registered player receiving a winning security code will be awarded a prize. No other claims will be valid utilizing or duplicating that code. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
(iv) Instant Win Prize Selection: One hundred (100) random, computer-generated winning times will be generated during the Promotion Period. If you are the first player during one of these randomly generated time periods, (in case of a tie, the Judge’s computer server log will determine “first click” time to confirm the winner) you will be a potential instant winner of the prize indicated. Odds of winning any instant win prize are based on the number of eligible game plays during the Promotion Period divided by the total number of prizes. Any prize that remains unclaimed will not be awarded in any Second Chance Drawing.

(c) APPLICABLE TAXES. Each winner of either the Grand Prize or Staples Gift Cards shall be solely responsible for all federal, state and local taxes, and the reporting consequences thereof, and for any fees or costs associated with the applicable prize. Each winner of a prize valued at $600 or more will be issued a 1099 Tax Reporting form at the end of the year. PLEASE NOTE: Prizes are not transferable by winner. No substitution of prize or cash equivalent is permitted except by Sponsor. Winner will look to the manufacturer of each prize element for all warranties and guarantees (if any), and not to Sponsor.
6) PUBLICITY: Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsor’s or its agents’ use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes relating to the announcement of winners of the Promotion in any media without further payment or consideration.
7) SWEEPSTAKES GENERAL CONDITIONS: Sponsor and/or Administrators may cancel or modify the Sweepstakes or these Official Rules if fraud, technical failures or any other factor beyond their control impairs the integrity of the Promotion, as determined by Sponsor and the Administrators in their sole discretion. In such event, Sponsor may award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor and Administrators may, in their sole discretion, disqualify any individual they find to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Sponsor and/or Administrators failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
8) INDEMNITY: By entering, entrant agrees to defend and indemnify at entrant’s expense Sponsor, Administrators, Promotion Entities, and their respective parents, subsidiaries, affiliates, dealers, directors, stock holders, officers, governors, employees and agents from and against any and all third party claims (however named or described), with respect to or arising out of either (i) entrant's participation; or (ii) the receipt or use of the prizes awarded in the Promotion
8) RELEASE; Limitations of Liability: Sponsor, Administrators and the Promotion Entities are not responsible for, and entrant hereby releases Sponsor, Administrators, and the Promotion Entities from any liability arising from: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Promotion; (iv) electronic or human error which may occur in the administration of the Promotion or the processing of entries; (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion; (vi) entrant's participation in the Promotion; or (vii) the receipt or use of the prizes awarded in the Promotion.
9) Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts located in the County of Los Angeles, State of California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
10) Participants’ Personal Information: By entering into this promotion, each entrant agrees to Sponsor’s and Promotion Entities’ and other related parties participating in this Sweepstakes use of personal information collected in this Sweepstakes.
