2. HOW TO ENTER: Promotion starts July 5, 1999 (12:01 AM EST) and
ends September 4, 1999 at (11:59 PM EST). In Person: On various dates from July
5, 1999 through September 4, obtain a free game card (the "Game Card")
at selected Pepsi ONE sampling events while supplies last. By Mail: send a self
addressed, stamped envelope, postmarked no later than September 4,1999 and
received no later than September 11, 1999, to "Pepsi Go Get One Game Card
Request," P.O. BOX 2253, Framingham, MA 01703, while supplies last. VT and
WA residents may omit return postage. Game Cards available while supplies last.
Limit one Game Card per person per sampling visit or per stamped return
envelope. All entries become the exclusive property of Sponsors. The Sponsors
reserve the right to limit the number of entries in the Promotion for any or no
reason at any time.
3. HOW TO PLAY THE "GET ONE" SPOT: Gently scratch off
the silver latex on the "Get ONE" area of the Game Card and you may
uncover a coupon for a FREE 2 Liter of Pepsi ONE (No. available 100,000; odds
1:30; Est. retail value $1.69/each) or a coupon for $0.55 off the purchase of a
12 or 24 multi-pack of Pepsi ONE (No. available 2,900,000; odds 1:1.03; Est.
retail value $0.55).
4. HOW TO REDEEM PEPSI ONE COUPONS: Redeem your Pepsi ONE coupons
by presenting the Game Card as you would a manufacturer’s coupon at any
participating retailer before September 30, 1999. Unclaimed Pepsi ONE
prize/coupons will not be awarded after September 30, 1999. Limit one coupon
redemption per person per store visit. Prizes are not transferable. All taxes,
fees and surcharges on prizes are the sole responsibility of winner.

Prizes are not transferable. Substitution
of prizes is not permitted, except by Sponsors, who reserve the right to
substitute a prize of equal or greater value if the prize cannot be awarded for
any reason. Prizes can not be redeemed for cash value. All taxes, fees and
surcharges on prizes are the sole responsibility of winner. All title, license,
registration and insurance fees for the Grand Prize are the sole responsibility
of Grand Prize winner.
No more than the stated number of prizes in these
Official Rules will be awarded, and if at any time the Sponsors, in their sole
discretion, determine that more valid prize claims have been received than the
number of prizes offered in any prize category, then the Sponsors may suspend
the awarding of prizes for that category until the end of the Promotion, any
remaining prizes for that category (up to the total listed) may be awarded via a
random drawing from among all persons submitting prize claims for that category
after prize awards were suspended, and sponsors shall have no further liability
in connection with the foregoing.
7. HOW TO REDEEM LYCOS LUCKY NUMBER PRIZE. If your Game Card has a
potential winning Lycos Lucky Number code, complete the information on the back
of your Game Card (please print) and mail it to "Pepsi ONE WINNER",
P.O. BOX 2001, Framingham, MA 01703.
8. VERIFICATION. All Game Cards, including the codes thereon, are
subject to review and verification on behalf of Sponsors by COHEN-FRIEDBERG
ASSOCIATES. Any decisions made by COHEN-FRIEDBERG ASSOCIATES and Sponsors shall
be final and binding in all matters relating to this Promotion. Anti-fraud
detection devices will be used to verify winning Game Cards. Game Cards will be
rejected, void and ineligible for a prize if they fail to pass the anti-fraud
detection measures and/or do not contain anti-fraud markings, are not obtained
through authorized legitimate channels, or if illegible, smudged, partially
printed, mutilated, altered, tampered with, unissued, stolen, photocopied,
mechanically reproduced or contain printing or mechanical errors or are printed
or reproduced. No prize will be awarded to the holder of a Game Card determined
to be void or otherwise ineligible.
9. SECOND CHANCE DRAWING. All unclaimed Lycos Lucky Number Prizes
will be awarded in a second chance sweepstakes drawing. You can enter the second
chance drawing online at www.lycos.com/gogetone by clicking on the "Pepsi
ONE Go Get One" icon. Limit one e-mail entry per e-mail address. To enter
by mail, complete the back of your Game Card, or on a 3 X 5 card complete your
name, address and telephone number, and mail to "Pepsi ONE Go Get ONE
Drawing," P.O. BOX 2242 Framingham, MA 01703. Limit one entry per e-mail
address or Game Card.
10. CONDITIONS
The Promotion is governed by these Official
Rules. By participating, entrants agree to these Official Rules, and understand
that the Promotion's results are final in all respects.
In the event of a
dispute regarding who submitted an online entry (email), the entry shall be
deemed submitted by the Authorized Holder (as defined below) of the email
account. Winners may be requested to provide Lycos with proof that such person
is the Authorized Holder (as defined below) of the email address associated with
the winning entry. "Authorized Holder" shall mean the natural person
assigned to an email address by an Internet access provider, on-line service
provider, or other organization that is responsible for assigning email
addresses for the domain associated with the submitted email address (e.g.,
business, educational institution, etc.).
The potential winners will each
be required to complete, execute and notarize an affidavit of eligibility and
release of liability and, where permitted by law, a publicity release. Each
potential winner's affidavit and release(s) must be signed and returned to
Sponsors within fourteen (14) days after the forms are provided by Sponsors; if
a potential winner fails to return to the Sponsors his/her affidavit and
release(s) within such fourteen-day period, such potential winner’s prize will
be forfeited and awarded to an alternate potential winner selected at random
from all eligible entries. If any prize or prize notification is returned as
non-deliverable, the potential winner will be disqualified and another potential
winner will be selected in the original potential winner's
place.
Entrants grant Sponsors the right to use and publish their proper
name and state of residence, online and in print, or in any other media, in
connection with the Promotion, or any promotions related thereto, unless
prohibited by law. Acceptance of a prize constitutes permission for Lycos and
its advertising and promotional agencies to use winners’ names, voices, and
likenesses for advertising and promotional purposes without additional
compensation, unless prohibited by law.
Sponsors may prohibit any entrant
from participating in this Promotion or any future promotion if, at the sole
discretion of Sponsors, such entrant (i) has tampered with the entry process or
the operation of the Promotion or Website, (ii) repeatedly shows a disregard for
the rules, or (iii) acts (a) in an unsportsmanlike manner, (b) with an intent to
annoy, abuse, threaten, or harass Sponsors or any other entrant, or (c) in any
other disruptive manner.
The Promotion may be terminated at any time
after its commencement without prior notice; however, any prizes due will still
be awarded.
The Promotion, and all promotions relating thereto, are
subject to all federal, state, and local laws and regulations. The Promotion,
and any promotions relating thereto, including the interpretation of these
Official Rules, are governed by the laws of the Commonwealth of Massachusetts,
and, by submitting an entry form, in any manner whatsoever, each entrant submits
to the personal jurisdiction of that state.
11. LIMITATIONS OF LIABILITY. Sponsors are not responsible for any
incorrect or inaccurate information, whether caused by Website users or by any
of the equipment or programming associated with the Promotion or by any
technical or human error which may occur in the processing of entries in the
Promotion. Sponsors assume no responsibility for any error, omission,
interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or authorized access to, or
alteration of, entries. Sponsors are not responsible for any problems or
technical malfunction of any telephone network or lines, computer
on-line-systems, servers or providers, computer equipment, software, failure of
email on account of technical problems or traffic congestion on the Internet or
at any Website or combination thereof, including injury or damage to
participants or to any other person’s computer related to or resulting from
participating or downloading materials in this Promotion. If, for any reason,
the Promotion is not capable of running as planned, including infection by
computer virus, bugs, tampering, unauthorized intervention, fraud, technical
failures, or any other causes beyond the control of Sponsors which corrupt the
administration, security, fairness, integrity or proper conduct of the
Promotion, Sponsors reserve the right at their sole discretion to cancel,
terminate, modify or suspend the Promotion. Sponsors shall have no liability
with respect to the Game Cards, including without limitation, Game Cards that
are not obtained through authorized legitimate channels, or if illegible,
smudged, partially printed, mutilated, altered, tampered with, unissued, stolen,
photocopied, mechanically reproduced or contain printing or mechanical errors or
are printed or reproduced. Sponsors are not responsible for late, lost,
illegible, incomplete, stolen, misdirected or postage due entries. Proof of
mailing is not proof of delivery.
12. INDEMNIFICATION AND RELEASE
By participating in the
Promotion, and any promotions relating thereto, each entrant agrees to release
and hold Lycos, Inc., and its respective employees, officers, directors, agents,
and representatives, Mitsubishi Motor Sales of America, Inc. and its licensees,
Pepsi-Cola Company, its bottlers, their suppliers, distributors and agencies
harmless from any and all losses, damages, rights, claims, and actions of any
kind including, without limitation, personal injuries, death, and property
damage, and claims based on publicity rights, defamation, or invasion of
privacy, either directly or indirectly related to or arising from the Promotion
or from acceptance, possession, misuse, or use of any prize.
13. WINNERS LIST. The Grand Prize winner "Official Winner's
List" will be posted at www.lycos.com/gogetone until November 30, 1999, or
you can send a self-addressed stamped envelope to "Pepsi ONE Go Get ONE
Winners List" PO BOX 2241, Framingham, MA 01703 postmarked no later than
September 17, 1999 and received by September 23,1999.
