YOUR CHANCES OF WINNING. Void where prohibited or restricted by law or regulation.
Internet access and a valid email address are required to enter. Free internet access is available at many
public libraries, while free email addresses are typically available from
google.com, yahoo.com or similar web sites.
1) Eligibility: The “Fun
in the Sun Trivia Game Sweepstakes (the "Promotion")
is open only to legal residents of the United States (excluding Puerto Rico,
U.S. Virgin Islands and Guam) who are 18
years of age or older at the time of entry and who live in CT, FL, MA, ME, NH, RI or VT. Employees of iParty, Inc. (the “Sponsor”), COHEN-FRIEDBERG ASSOCIATES, LLC (the “Judges”), Collectively (the “Promotion Entities”), and all of their
respective parents, subsidiaries, dealers, affiliates, directors, officers,
shareholders, governors, employees, and agents, as well as their respective
spouses, children, siblings, and all others residing in the same household as
such employees, are not eligible to participate. The Promotion is subject to
all federal, state, and local laws and regulations. Void where prohibited by
law.
2) Agreement to Official Rules: By participating in this Promotion,
each entrant agrees to abide by these Official Rules and the decisions of the
Judges, which are final and legally binding as they pertain to this promotion.
All entries become the property of the Sponsor.
3) Timing: Promotion starts at 12:01 am (ET) on Wednesday,
April 30, 2008 and ends at 11:59 pm (ET) on Monday,
June 30, 2008
(the "Promotion Period"). The clock maintained by the Judges
in connection with the operation of the Promotion at the www.funatiparty.com
website (the “Website”) will be the
official timekeeper for this Promotion.
4) How to Enter and Play:
a) Register to play: During the Promotion Period, visit www.funatiparty.com, click on the Fun in the Sun Trivia Game
Sweepstakes icon
and complete the online registration form and click “submit”. Registration may
include the following: name, complete address, city, state, zip, age and telephone
number. After you have submitted your registration, you will automatically
advance to the trivia game page to receive one free (1) game play. Each time
you return to play, you will be required to log-in utilizing your e-mail
address and your game password.
b) How to play: When you enter the trivia game
page, you will be offered the opportunity to answer five (5) trivia questions.
If you answer all five (5) correctly, you will automatically be entered into
the Sweepstakes. Limit: One (1) game play per person or email address per calendar day (as determined
by the Website’s clock Eastern Time) during the Promotion Period.
5) PRIZES AVAILABLE TO BE WON:
ONLY THE NUMBER OF PRIZES LISTED
BELOW WILL BE AWARDED IN THIS
PROMOTION. Odds of winning depend on the number of valid entries
received.
(1) GRAND
PRIZE: 5-night/6-day trip for two to the
Divi Village Golf & Beach Resort in Aruba. Prize includes the following:
• Roundtrip (coach class)
airfare for two (2) as provided from a major airport closest to the winner’s
home address.
6-Days/5-Nights Resort
(double occupancy) Accommodations as provided by the Divi Village Golf and
Beach Resort, Aruba.
Approximate Retail Value
$3,500.
PLEASE NOTE: Prizes are not transferable by winner. No
substitution of prize or cash equivalent is permitted except by Sponsor. Winner
will look to the manufacturer of each prize element for all warranties and
guarantees (if any), and not to the Sponsor.
Prize
Notes: Prize value may vary based on airfare
fluctuations and hotel availability. All travel reservations must be made 30
days in advance. Travel arrangements must be booked through Sponsors’ agent and
on a carrier of Sponsors’ choice. Travel
arrangements cannot be changed in any way once booked and confirmed. Travel is subject to availability and certain
travel restrictions and blackout dates may apply. Blackout dates include but
are not limited to: seven (7) days before and after all major U.S. holidays. Prize is valid for one calendar year from
issue date. No extension will be given
after the trip has expired and prize will be forfeited and Sponsor will have no
further obligation to winner. Sponsor is
not responsible for lost or stolen prize certificates/redemption letters and
the prize is not redeemable without the original prize certificates/ redemption
letters. Winner is responsible for any and all local, state and/or federal
taxes, as well as any other costs and expenses not specified herein as being
awarded, including, without limitation, ground transportation, food, beverage,
gratuities, golf, inter-island transportation, tours, gift shop purchases,
incidentals, telephone calls or other personal expenses or hotel charges
incurred. The winner and travel guests must be 18 years of age or older, or if
any such guest is a minor, they must be
accompanied by the minor's parent or legal guardian. Winner and guest must have a valid Passport
and/or any other required travel documentation including a valid visa (if
required) prior to departure date from the United States. Winner and guest must
travel depart/return on the same flights on the same day. Winner and guest are
responsible for all expenses not listed above.
Air tickets are non-refundable/non-transferable and are not valid for
upgrades and/or frequent flyer miles.
Total Approximate Retail Value of
all prizes $3,500. The
winner shall be solely responsible for all federal, state and local taxes, and
the reporting consequences thereof, and for any fees or costs associated with the
applicable prize. The Grand Prize winner will be issued a federal form 1099 at
the end of the year.
6. Drawing: The random drawing will take place
on or about 7/14/2008 from all eligible entries received
during the Promotion Period and will be under the control of the Judges an
independent judging agency, contracted by the Sponsor, whose decisions are
final and legally binding, as they pertain to the Sweepstakes. The potential
winner will be notified by email, telephone, overnight carrier or regular mail
whichever is appropriate within approximately three (3) days of the
drawing. If the Judges are unable to
contact the potential winner after reasonable effort, or if the potential
winner fails to reply within ten (10) days of first attempted notification,
prize will be forfeited and awarded to an alternate winner from among all
remaining eligible entries.
Second Chance Drawing Sweepstakes: Each participant that completes all trivia questions
and is entered into the Sweepstakes will automatically be entered into the
Second Chance Drawing for any unclaimed Grand Prize (if any). A random drawing
will be conducted on or about July 25, 2008 from all eligible entries
received. Odds of winning depend on the total number of valid entries received
and the number of unclaimed prizes (if any).
For
all entries: In
the event of a dispute as to any online entry, the authorized account holder of
the email address used to enter will be deemed to be the entrant. The
"authorized account holder" is the natural person assigned an email
address by an Internet access provider, online service provider or other
organization responsible for assigning email addresses for the domain
associated with the submitted address. Potential winners may be required to
show proof of being the authorized account holder.
7) ALL ENTRIES ARE SUBJECT TO VERIFICATION BY THE
JUDGES, WHOSE DECISIONS ARE FINAL AND LEGALLY BINDING. AN ENTRANT IS
NOT A WINNER OF ANY PRIZE, UNTIL ENTRANT'S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS
COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR COPIES OF SCREEN CONTENT OR ANY OTHER
EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS
AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.

Potential Game Winners: The Grand Prize winner must comply with all terms and
conditions of these Official Rules and winning is contingent upon fulfilling
all requirements. The winner of a major prize (prize valued over $600 must complete, sign and return an Affidavit of
Eligibility and Liability/Publicity Release within ten (10) days, consenting to
the publication of his/her name in any media for any promotional purpose
relating to the announcement of winners of the Promotion, without further
compensation. If a potential winner cannot be contacted, or if he/she fails to
sign and return the Affidavit of Eligibility and Liability/Publicity Release
within the required time period or if notices are returned as undeliverable, an
alternate winner will be selected from the Second Chance drawing pool. The
Second Chance Drawing winner will be notified by email, mail or express
delivery whichever is appropriate and will be required to complete and return
an Affidavit of Eligibility and Liability/Publicity Release as described within
ten (10) days of notice to receive the prize. Only up to two (2) Second Chance
Drawings will be held after which, the prize will remain unawarded.

Publicity: Except
where prohibited, participation in the Promotion constitutes winner's consent
to Sponsor's or agents the use of winner's name, likeness, voice, opinions,
biographical information, hometown and state for promotional purposes relating
to the announcement of winners of the Promotion in any media without further
payment or consideration.
10)
General Conditions: Sponsor and/or Judges may cancel or modify the Promotion or these Official
Rules if fraud, technical failures or any other factor beyond their control
impairs the integrity of the Promotion, as determined by Sponsor and the Judges
in their sole discretion. In such event, Sponsor may award the prizes at random
from among the eligible entries received up to the time of the impairment.
Sponsor and Judges may, in their sole discretion, disqualify any individual
they find to be tampering with the entry process or the operation of the
Promotion or to be acting in violation of these Official Rules, or in an
unsportsmanlike or disruptive manner. Sponsor and/or Judges failure to enforce
any term of these Official Rules shall not constitute a waiver of that
provision.
11)
Release: By entering entrant agrees to hold harmless and
indemnify the Sponsor, Judges, Promotion Entities, and their respective
parents, subsidiaries, affiliates, dealers, directors, stock holders, officers,
governors, employees and agents against any and all liability, damages or
causes of action (however named or described), with respect to or arising out
of either (i) entrant's participation; or (ii) the receipt or use of the prizes
awarded in the promotion.

Limitations of Liability: Sponsor, Judges and the Promotion Entities are not responsible for, and
entrant hereby releases Sponsor, Judges, and the Promotion Entities from any
claims arising from: (i) technical failures of any kind, including but not
limited to the malfunctioning of any computer, cable, network, hardware or
software; (ii) the unavailability or inaccessibility of any transmissions or telephone
or Internet service; (iii) unauthorized human intervention in any part of the
entry process or the Promotion; (iv) electronic or human error which may occur
in the administration of the Promotion or the processing of entries; or (v) any
injury or damage to persons or property, including but not limited to entrant's
computer, hardware or software, which may be caused, directly or indirectly, in
whole or in part, from entrant's participation in the Promotion.
13) Disputes: Except where prohibited, entrant agrees that: (1) any and all
disputes, claims and causes of action arising out of or connected with this
Promotion or any prize awarded shall be resolved individually, without resort
to any form of class action, and exclusively by the Commonwealth of Massachusetts;
(2) any and all claims, judgments and awards shall be limited to actual
out-of-pocket costs incurred, including costs associated with entering this
Promotion, but in no event attorneys' fees; and (3) unless otherwise
prohibited, under no circumstances will entrant be permitted to obtain awards
for, and entrant hereby waives all rights to claim, indirect, punitive,
incidental and consequential damages and any other damages, other than for
actual out-of-pocket expenses, and any and all rights to have damages
multiplied or otherwise increased. All issues and questions concerning the
construction, validity, interpretation and enforceability of these Official
Rules, or the rights and obligations of the entrant and Sponsor in connection
with the Promotion shall be governed by,
and construed in accordance with, the laws of the Commonwealth of
Massachusetts, without giving effect to any choice of law or conflict of law
rules (whether of the Commonwealth of Massachusetts or any other jurisdiction),
which would cause the application of the laws of any jurisdiction other than
the Commonwealth of Massachusetts.
14) Participants Personal Information: By entering into this promotion, each
entrant agrees to Sponsor and Promotion Entities use of his or her personal
information as described in the website’s Privacy Policy located at http://www.funatiparty.com
and these official Rules. In the event of any discrepancy, these Official Rules
shall control and govern. The personal information collected in this promotion
may be shared with the Promotion Entities and other related parties
participating in this promotion.
15)
Winners List: For a list of prize winners and a copy of these Official Rules send a
self-addressed, stamped envelope to “Fun in The Sun Trivia
Game Sweepstakes!”
