Free internet access is available at many public libraries, while free email addresses are typically available from google.com, yahoo.com or similar web sites.You may enter the Sweepstakes bycompleting the Official Entry Form located at www.partycity.com.

1) Eligibility: The Party-A-Day Giveaway Plus Win a Party City Ultimate Party for 50 Sweepstakes (the "Promotion") is open only to legal residents of the United States (excluding Puerto Rico, U.S. Virgin Islands and Guam) who are 18 years of age or older at the time of entry. Employees of Amscan Holdings, Inc. D/B/A Party City (the “Sponsors”), COHEN-FRIEDBERG ASSOCIATES, LLC (the “Administrators”) and collectively (the “Promotion Entities”), and all of their respective parents, subsidiaries, Franchisees, dealers, affiliates, directors, officers, shareholders, governors, employees, and agents, as well as their respective spouses, children, siblings, and all others residing in the same household as such employees, are not eligible to participate. The Promotion is subject to all federal, state, and local laws and regulations. Void where prohibited by law.

2) Agreement to Official Rules: By participating in this Promotion, each entrant agrees to abide by these Official Rules and the decisions of the Administrators, which are final and legally binding as they pertain to this promotion. All entries become the property of the Sponsors.

3) Timing: Promotion starts at 12:01 am Eastern Time (“ET”) on Wednesday, August 26, 2009 and ends 11:59 pm ET on Saturday, September 26, 2009(the "Promotion Period"). The clock maintained by the Administrators in connection with the operation of the Promotion at the promotion website (the “Website”) will be the official timekeeper for this Promotion. Only one registration is necessary, but the sooner you register, the more chances to win. LIMIT: One registration per person for the Promotion Period. Multiple registrations by the same person will result in disqualification for any prize awards. LIMIT: One (1) prize per person or household address over the promotion period.

4) How to Enter: You may enter the Sweepstakes by completing the online Official Entry Form found www.partycity.com between 8/26/2009-9/26/2009.  Registration may include the following: name, complete address, city, state, zip, age, email address and telephone number. After you have submitted your registration, you will automatically be entered into the all of the Sweepstakes drawings.  Entries will be placed into the drawing period based on the date of entry receipt, as solely determined by the Website’s clock.  All non-winning entries received for a given drawing period WILL be retained for remaining drawings.

There will be one (1) Party-A-Day drawing will be conducted each day for Thirty (30) days plus a Grand Prize Ultimate Party drawing. Daily drawings will be conducted the day after each entry period ends. Drawings will be conducted as follows:

Drawings & Winner Selection:  Random Sweepstakes drawings will be conducted on or about the dates listed above from all valid entries received. The Sweepstakes drawing will be under the control of the Administrators whose decisions shall be final and legally binding as they pertain to this Sweepstakes. Grand Prize winner will be notified within 10 days of the drawing via phone, email, mail or express mail whichever is appropriate. Failure to reply to this prize winning notification within 10 days of notification to claim prize, will disqualify the entry and an alternative winner will be selected from all eligible entries received for the Sweepstakes.  All Party-A-Day winners will receive their prize via mail within 15 days of the final drawing. Odds of winning depend on the total number of eligible entries received. Incomplete, illegible or entries made by automated programs will be automatically disqualified.  No responsibility is assumed for lost, late, misdirected, damaged, altered or illegible entries. Any attempted form of entry other than as described herein is void. Administrators and or Sponsor will determine in it sole discretion what constitutes a valid entry.  In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.

5) PRIZES:  ONLY THE NUMBER OF PRIZES LISTED BELOW WILL BE AWARDED IN THIS PROMOTION.
One (1) Grand Prize: ULTIMATE PARTY for 50. Prize includes the following:

• $500 Merchandise Certificate valid at partycity.com to purchase decorations, tableware, party favors, invitations; anything you need to conduct your ultimate party.
• $500 Cash to purchase your party food, beverages, cake, etc.

Approximate retail value $1,000.

Thirty (30) DAILY PRIZES:  Party City $100 Merchandise Certificateawarded in each drawing based on the drawing schedule listed in rule #4.  Approximate retail value $100 each.Certificate redeemable online at www.PartyCity.com. Terms and conditions of the Merchandise Certificate redemption apply.

Grand Prize Winner Notification: The Grand Prize winner will be required to complete and return an Affidavit of Eligibility and a Liability/Publicity Release form which must be signed by the Winner and received by Sponsor or its designated agent within ten (10) days of the date printed on the notification or otherwise an alternate Winner will be selected from all remaining valid entries.

PLEASE NOTE: Contractual restrictions may prevent us from shipping to your specific geographic location. If this occurs, the winner will receive a $100 gift card valid at all Party City store locations. Prizes are not transferable by winner. No substitution of prize or cash equivalent is permitted except by Sponsors. Merchandise Certificates expire on 12/31/2010 and must be redeemed on one online order (no change). Winner will look to the manufacturer of each prize element for all warranties and guarantees (if any), and not to the Sponsor.

6) ALL POTENTIAL WINNING ENTRIES ARE SUBJECT TO VERIFICATION BY THE ADMINISTRATORS, WHOSE DECISIONS ARE FINAL AND LEGALLY BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY HAVE BEEN VERIFIED. 

7) Potential Winners: ALL Potential winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.  If a potential winner cannot be contacted, or if notices or prizes are returned as undeliverable, that prize will become null and void and will not be awarded.  If any prize is not awarded during the Promotion Period or remains unclaimed, that prize will become null and void and will not be awarded.

8) Publicity: Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsor's or agents use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes relating to the announcement of winners of the Promotion in any media without further payment or consideration.

9) General Conditions: Sponsors and/or Administrators may cancel or modify the Promotion or these Official Rules if fraud, technical failures or any other factor beyond their control impairs the integrity of the Promotion, as determined by Sponsors and the Administrators in their sole discretion. In such event, Sponsors may award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsors and Administrators may, in their sole discretion, disqualify any individual they find to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Sponsors and/or Administrators failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10) Release: By entering entrant agrees to hold harmless and indemnify the Sponsors, Administrators, Promotion Entities, and their respective parents, subsidiaries, affiliates, dealers, directors, stock holders, officers, governors, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant's participation; or (ii) the receipt or use of the prizes awarded in the promotion.

11) Limitations of Liability: Sponsors, Administrators and the Promotion Entities are not responsible for, and entrant hereby releases Sponsor, Administrators, and the Promotion Entities from any claims arising from: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Promotion; (iv) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion.

12) Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state of New Jersey; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the state of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the state of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New Jersey.

13) Participants Personal Information: By entering into this promotion, each entrant agrees to Sponsors’ and Promotion Entities’ use of his or her personal information as described in the website’s Privacy Policy of each (if any) and these official Rules. In the event of any discrepancy, these Official Rules shall control and govern. The personal information collected in this promotion may be shared with the Promotion Entities and other related parties participating in this promotion.

Vermont residents may omit return postage. Requests must be received by 9/26/2009.
