Dream a Princess Dream Game

OFFICIAL RULES AND REGULATIONS

NO PURCHASE REQUIRED to play or to win. YOU HAVE NOT YET WON! A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited or restricted by law or regulation. Internet access and a valid email address are required to enter. Free internet access is available at many public libraries, while free email addresses are typically available from google.com, yahoo.com or similar web sites.

1) Eligibility: The Dream a Princess Dream Game (the "Promotion") is open only to legal residents of the United States (excluding Puerto Rico, U.S. Virgin Islands and Guam) who are 14 years of age or older at the time of entry. Employees of Amscan Holdings, Inc. D/B/A Party City, Party America, and Factory Card & Party Outlet (the “Sponsors”), COHEN-FRIEDBERG ASSOCIATES, LLC (the “Administrators”), The Walt Disney Company, collectively (the “Promotion Entities”), and all of their respective parents, subsidiaries, Franchisees, dealers, affiliates, directors, officers, shareholders, governors, employees, and agents, as well as their respective spouses, children, siblings, and all others residing in the same household as such employees, are not eligible to participate. The Promotion is subject to all federal, state, and local laws and regulations. Void where prohibited by law.

2) Agreement to Official Rules: By participating in this Promotion, each entrant agrees to abide by these Official Rules and the decisions of the “Administrators”, which are final and legally binding as they pertain to this promotion. All entries become the property of the Sponsors.

3) Timing: Promotion starts at 12:01 am Eastern Time (“ET”) on Monday, September 14, 2009 and ends 11:59 pm ET on Saturday, October 31, 2009 (the "Promotion Period"). The clock maintained by the Administrators in connection with the operation of the Promotion at the promotion website (the “Website”) will be the official timekeeper for this Promotion.

4) How to Enter and Play:
a) Enter The Grand Prize Sweepstakes: You may enter the Grand Prize Sweepstakes by visiting www.partycity.com or www.partyamerica.com, or www.factorycard.com, click on the Dream a Princess Dream icon or banner to complete the online Registration form and click “submit”. Registration may include the following: name, complete address, city, state, zip, age, email address and telephone number. After you have submitted your registration, you will automatically be entered into the Grand Prize Sweepstakes. Drawings & Winner Selection: A random Sweepstakes drawing will be conducted on or about Monday, November 9, 2009 from all valid entries received. The Sweepstakes drawing will be under the control of the Administrators whose decisions shall be final and legally binding as they pertain to this Sweepstakes. Winner will be notified within 10 days of the drawing via phone, email, mail or express mail whichever is appropriate. Failure to reply to this prize winning notification within 10 days of notification to claim prize, will disqualify the entry and an alternative winner will be selected from all eligible entries received for the Sweepstakes. Odds of winning depend on the total number of eligible entries received. Incomplete, illegible or mutilated entries will be automatically disqualified. No responsibility is assumed for lost, late, misdirected, damaged, altered or illegible entries. Any attempted form of entry other than as described herein is void. Administrators and or Sponsor will determine in it sole discretion what constitutes a valid entry.

b) Register to play the instant win game: During the Promotion Period, visit www.partycity.com, www.partyamerica.com, or www.factorycard.com, click on the Dream a Princess Dream Instant Win Game icon or banner to complete the online Registration form and click “submit”. After you have submitted your registration, you will automatically advance to the game page to receive one (1) Game Play. Each time you return to play, you will be required to log-in utilizing your “e-mail address” and your game “password”.

c) How to play the Online Instant Win Game: Each time you enter the game page, you will be offered the opportunity to play the Dream a Princess Dream Game. Utilizing your computer mouse curser, click on one (1) of the three (3) Princess Tiaras. You will instantly know if you have a game winning play and the prize won (pending verification). Check the instant prizes available to be won (See Rule #5). A winning game play message will advise winner when to anticipate the delivery of their prize. Limit: One (1) Game Play per person or email address per calendar day (as determined by the Website’s clock Eastern Time) during the Promotion Period. Only one prize per email address or household over the Promotion Period.

All winning game plays will contain a onetime use security code validation code. No prize will be awarded on any game play or screen shot not containing such code. Only the registered player receiving a winning security code will be awarded a prize. No other claims will be valid utilizing or duplicating that code. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.

5) Instant Win Prize Selection: Forty-five (45) random, computer-generated winning times will be generated across the Promotion Period. If you are the first player during one of these randomly generated time periods, (in case of a tie, the Judge’s computer server log will determine “first click” time to confirm the winner) you will be a potential instant winner of the prize indicated . Odds of winning any instant win prize are based on the number of eligible game plays during the Promotion Period divided by the total number of prizes. Any prize that remains unclaimed will not be awarded in any Second Chance Drawing.

Grand Prize and First Prize note: Winner Notification: Each winner will be required to complete and return an Affidavit of Eligibility and a Liability/Publicity Release form which must be signed by the Winner and guests and received by Sponsor or its designated agent within ten (10) days of the date printed on the notification or otherwise an alternate Winner will be selected from all remaining valid entries. If the Winner is under the age of majority, a parent or legal guardian will be required to execute the Affidavit of Eligibility and a Liability/Publicity Release form on the Winner's behalf. Prizes won by a minor, will be awarded in the name of a parent of legal guardian, for the benefit of the minor. If the winner of the Grand Prize is a minor his/her parent or legal guardian must travel as one of the guests.

PRIZE NOTE: Location of the Disney Princess Dream Royal Ball to be determined; at the time the prize is redeemed, based on the winner’s location and time of year the event will be held. If the winner chooses to hold the “Ball” during the winter months in cold or snow bound climates it might be necessary to hold the “Ball” indoors. Winner shall be solely responsible for providing an adequate venue for the Dream a Princess Dream Royal Ball to be conducted. All details of the Dream a Princess Dream Royal Ball including the Princess appearance, will be subject to Sponsor approval in their sole discretion. The winner shall be solely responsible for all federal, state and local taxes, and the reporting consequences thereof, and for any fees or costs associated with the applicable prize. The Grand Prize winner will be issued a 1099 Tax Reporting form at the end of the year.

6) ALL POTENTIAL INSTANT WINNING PLAYS ARE SUBJECT TO VERIFICATION BY THE ADMINISTRATORS, WHOSE DECISIONS ARE FINAL AND LEGALLY BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE INSTANT WIN GAME PORTION OF THE PROMOTION SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR COPIES OF SCREEN CONTENT OR ANY OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.

7) Potential Game Winners: ALL Potential winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements If a potential winner cannot be contacted, or if notices or prizes are returned as undeliverable, that prize will become null and void and will not be awarded. If any prize is not awarded during the Promotion Period or remain unclaimed, that prize will become null and void and will not be awarded. Eligible Winners of all other Instant Win prizes will receive their prizes within 4-6 weeks after the conclusion of the Promotion Period.

8) Publicity: Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsor's or agents use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes relating to the announcement of winners of the Promotion in any media without further payment or consideration.

9) General Conditions: Sponsors and/or Administrators may cancel or modify the Promotion or these Official Rules if fraud, technical failures or any other factor beyond their control impairs the integrity of the Promotion, as determined by Sponsors and the Administrators in their sole discretion. In such event, Sponsors may award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsors and Administrators may, in their sole discretion, disqualify any individual they find to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Sponsors and/or Administrators failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10) Release: By entering entrant agrees to hold harmless and indemnify the Sponsors, Administrators, Promotion Entities, and their respective parents, subsidiaries, affiliates, dealers, directors, stock holders, officers, governors, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant's participation; or (ii) the receipt or use of the prizes awarded in the promotion.

11) Limitations of Liability: Sponsors, Administrators and the Promotion Entities are not responsible for, and entrant hereby releases Sponsor, Administrators, and the Promotion Entities from any claims arising from: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Promotion; (iv) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion.

12) Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state of New Jersey; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the state of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the state of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New Jersey.

13) Participants Personal Information: By entering into this promotion, each entrant agrees to Sponsors’ and Promotion Entities’ use of his or her personal information as described in the website’s Privacy Policy of each (if any) and these official Rules. In the event of any discrepancy, these Official Rules shall control and govern. The personal information collected in this promotion may be shared with the Promotion Entities and other related parties participating in this promotion.

Vermont residents may omit return postage. Requests must be received by 10/31/2009.
