ELIGIBILITY: No purchase necessary. Open to legal residents of the 50 United States and the District of Columbia, (“U.S.”) who are at least 14 years of age or older (ME residents must be 19 years of age or older to enter) at the time of entry living in CT, DE, FL, GA, MA, MD, ME, NH, NJ, NY, NC, PA, RI, SC, TN, VA, VT, and WV. (“Sponsor”), Cohen-Friedberg Associates, LLC (“Administrators”), participating Food Chains and Supermarkets (Acme, Albertsons, A&P, BJ’s, Bilo, Demoulas Market Basket, Food Basics, Food Master, Food Lion, Food Town, Giant Eagle, Giant Markets, Hannaford Brothers, Key Food, King Kullen, King’s, Kmart, Kuhn’s, P&C, Pathmark, Price Chopper, Riesbeck’s, Roche Brothers, Shaw’s, Shop & Save, ShopRite, Stop & Shop, Sweetbay, Target, Thorne’s, Tops, Wal-Mart, Wegman’s, Weis Market and Winn Dixie, collectively (the “Promotion Entities”), and their respective parents, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and members of the immediate family or household of each, are not eligible to participate or win. Immediate family member is defined as a parent, sibling or any person residing in same household as employee.
PROMOTION PERIOD: The Sweepstakes and the Instant Win game begins on or about Friday, January 1, 2010 at 12:01 a.m. Eastern Time (“ET”) and ends on Monday, March 1, 2010 at 11:59:59 p.m. ET ("Promotion Period"). LIMITS: One (1) Sweepstakes registration per person or email address over the Promotion Period (See Rule #4). Limit: One Win & Save game play per day per person or email address. Limit one (1) instant prize per person or household over the Promotion Period. No responsibility is assumed by Sponsor for lost, late, misdirected, illegible, incomplete or, stolen, entries or for any computer, online, telephone or technical malfunctions that may occur. The Website's clock will be the official timekeeper for this Promotion. All entries become the property of the Sponsor and will not be returned.
PRIZES/ODDS: Only the number of prizes listed below will be awarded.
SWEEPSTAKES PRIZE: Odds of winning based upon the total number of valid entries.
One (1) Grand Prize: $1,000 Grocery Gift Card. All eligible persons who complete the registration form will be entered into the grand prize drawing. Persons winning an instant prize are still eligible for the grand prize. Gift Card retailer will be determined by the winner’s registration selection. Terms and conditions of the specific retailer Gift Card apply. Approximate retail value $1,000 each.
INSTANT WIN PRIZES: Odds of winning any instant win prize are based on the number of eligible game plays during the Promotion Period divided by the total number of prizes. Instant Win Prize Selection: One-Hundred and Twenty (120) random, computer-generated winning times will be generated across the Promotion Period. If you are the first player, during one of these randomly generated time periods, to play the Wise® Win & Save Instant Win game (in case of a tie, the Judge’s computer server log will determine “first click” time to confirm the winner), you will be a potential instant winner of the prize indicated. Additional random generated times may be added to award unclaimed Instant Prizes. See complete list of Instant Win Prizes and details below. If a player does not claim a winning prize when prompted on the winning game page, the prize will be forfeited as the player will not be able to revisit the winning game page to claim any prize. All winning game plays will contain a one-time use security validation code. No prize will be awarded on any game play or screen shot not containing such code. Only the registered player receiving a winning security code will be awarded a prize. No other claims will be valid utilizing or duplicating that code.

HOW TO ENTER AND PLAY:
a) Enter The Grand Prize Sweepstakes: During the Promotion Period you may enter by registering at www.Wisesnacks.com/freegroceries, click on the Wise® Win & Save Sweepstakes & Instant Win Game Icon or game banner to complete the online Registration form and click “submit”. Registration may include the following: name, complete address, city, state, zip, age, email address, password, telephone number grocery chain you would like to win a Grocery Gift Card from and the preferred Wise® product you would like to win. After you have submitted your registration, you will automatically be entered into the Grand Prize Sweepstakes. LIMIT: One Sweepstakes entry over the course of the Promotion Period per person or email address. LIMIT: One prize per person or dwelling. Drawings & Winner Selection: A random Sweepstakes drawing will be conducted on or about Wednesday, March 10, 2010 from all valid entries received. The Sweepstakes drawing will be under the control of the Administrators whose decisions shall be final and legally binding as they pertain to this Sweepstakes. Winner will be notified within 10 days of the drawing via phone, email, mail or express mail, whichever is appropriate. Failure to reply to this prize winning notification within 10 days of notification to claim prize, will disqualify the entry and an alternative winner will be selected from all eligible entries received for the Sweepstakes. Odds of winning depend on the total number of eligible entries received. Incomplete, illegible or mutilated entries will be automatically disqualified. No responsibility is assumed for lost, late, misdirected, damaged, altered, or illegible entries. Any attempted form of entry other than as described herein is void. Administrators and or Sponsor will determine in its sole discretion what constitutes a valid entry.
b) Play the instant win game: During the Promotion Period, visit www.Wisesnacks.com/freegroceries, click on the Wise® Win & Save Sweepstakes & Instant Win Game Icon or banner to complete the online Registration form and click “submit”. After you have submitted your registration, you will automatically advance to the game page to receive one (1) Game Play. Each time you return to play, you will be required to log-in utilizing your “e-mail address” and your game “password”. Each time you enter the game page, you will be offered the opportunity to play the Wise® Win & Save Instant Win Game! To begin, click on “click here to spin the wheel”. The wheel will begin to spin. When the wheel stops spinning, the game play results will instantly appear. If there is a winning game play spin, a game play message will advise winner when to anticipate the delivery of their prize. Limit: One (1) Game Play per person or email address per calendar day (as determined by the Website’s clock Eastern Time) during the Promotion Period. Only one prize per email address or dwelling over the Promotion Period.
GENERAL: The potential winners of any prize valued at $600 (USD) or more will be required to sign and return a notarized Affidavit of Eligibility, a Liability Release, and, where legal, a Publicity Release, within ten (10) days of first attempted notification. In the event that any winner is under the age of 18, the winner’s parent or legal guardian (“Parent”) will need to co-sign the Affidavit. In the event a Grand Prize winner is a minor, the prize will be awarded in the name of a parent or legal guardian for the benefit of the minor. In the event of noncompliance, the potential Grand Prize winner may be disqualified and an alternate winner selected, at Sponsor’s sole discretion. By participating, participants (a) agree to be bound by the Official Rules and the decisions of the Sponsor and Administrators (including but not limited to eligibility determinations) which are final and legally binding in all respects; (b) agree to release and hold harmless the Promotion Entities and their employees and agents from any and all threatened or actual claims, actions, liabilities, losses, damages or injuries arising in whole or in part, directly or indirectly from participation in this Promotion, the award, receipt, possession, use and/or misuse of any prize awarded herein and acknowledge that Sponsor, Administrators and their employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; and (c) consent to use of his/her name, photograph and/or likeness for advertising and promotional purposes in any and all media now known or hereinafter developed (including but not limited to digital, Internet and the World Wide Web) without additional compensation, unless prohibited by law.
INTERNET: If, for any reason, the Internet portion of this promotion is not capable of running as planned, whether due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes or instant win game, Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. In the event of termination, random drawings to award the prizes will be conducted from eligible entries received up until the time of termination. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
DISPUTES: This Promotion is governed by the laws of the United States and the state of Pennsylvania, without respect to conflict of law doctrines. As a condition of participating in this Promotion, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Pennsylvania having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
